In addition to the terms of agreement established by and through the booking process, these terms and conditions further state the respective obligations and responsibilities of Modern Retreats, LLC (hereinafter “the Manager”), and the rental applicant, being the person who secured this rental property through a booking company (hereinafter, the “Rental Applicant”), and including all other individuals listed or subsequently added by the Rental Applicant (individually, a “Renter,” and collectively, the “Rental Group”). The Rental Applicant is considered to be the lead Renter and will assume full responsibility for all members of the Rental Group throughout the rental period. Information or instructions relating to this rental will be communicated to the Rental Applicant only and not to any other Renter. In the event of any dispute between the Manager, the Rental Applicant and/or the Rental Group, the provisions agreed to through the booking site as well as these terms and conditions shall form the entire agreement and the basis for any resolution. Please read them carefully before confirming your booking, as it is understood and agreed that each and every party is intending to be legally bound hereby. The Rental Group shall also abide by any other instructions contained in the Welcome Letter to be delivered at the time of occupancy.

1. Occupancy of the property

Occupancy of the property is restricted to those names initially listed through the booking company or added subsequently by the Rental Applicant. Regardless of the published maximum number of persons a property can accommodate, the total number of guests occupying the property is strictly limited to those named on the rental agreement or any subsequent amendment agreed to in writing with the Manager. The stated and agreed occupancy figure includes all persons irrespective of age, day and overnight guests. Exceeding the number of stated and agreed persons may result in immediate eviction without refund, or a $300 per additional guest per night charge, at the discretion of the Manager. Breaking any of the following rules may subject the Rental Group to dismissal from the property, and loss of any security deposit in its entirety, in addition to further damages, as arising out of any negligence, reckless or intentional misconduct of any Renter.
– Maximum parking is 4 spaces. Parking on the street is prohibited.

2. Check In/Check Out

Check-In: 4:00PM / Check-Out: By 11:00AM
If you leave the property after 11:00AM on your checkout day (without getting approval from the Manager), there will be a charge of $200/hour. For example, if you leave the property at 11:15AM, you will be charged $200.00.

3. Requirements to Confirm Reservation

AGREEMENT
Please agree to terms and conditions within 48 hours of booking,
IDENTIFICATION
Please provide a copy of your credit card and your photo ID. The credit card on file, ID, and the signer of the rental agreement all must match. This is to avoid fraud.
DEPOSIT INFORMATION
We take a 50% deposit at the time of the booking, and the remaining 50% is due 60 days prior to your arrival. If you are booking within 60 days of arrival, the full amount will be charged upon booking.

4. Cancellation Policy

Travelers who cancel at least 60 days before check-in will get back 100% of the amount they’ve paid. If they cancel after that point, we will refund any amount that gets rebooked. Travel insurance is available to cover your vacation in the event something unexpected pops up. Please ask for details if this is something you would like to purchase. Please note, while we understand that life circumstances can impact your travel plans, we cannot be held responsible for refunds within the 60 day no cancellation window.

5. Condition of the property

The property will have been inspected prior to occupation and therefore the Rental Group undertakes to:
– Notify the Manager immediately with regard to any damage and/or maintenance issues that require attention.
– Keep the property and all furniture, fixtures, fittings, chattels and effects in or about the property in the same state of repair and condition as found at the commencement of the rental period.
– DO NOT MOVE FURNITURE.
– The Rental Group shall follow the departure instructions provided by the Manager.

6. Trash and Parking

Trash: Garbage should be placed IN the trash bins in the garage. The collection schedule is outlined in the Welcome Letter. Please have all trash in the bins the night before pickup. The trash company will open the garage to retrieve the bins. Please leave enough room to get by your car/s in the garage & driveway or they aren’t able to take the trash. Let me know if there are any issues.
MAKE SURE ALL TRASH IS IN THE BINS. There is an extra charge for anything outside the bins.
Parking: Please note that street parking is not permitted. A maximum of 4 guest vehicles may be parked at the property at any time during the stay. Garage doors must generally be kept down.

7. Use of Cable

All additional cable charges must be approved before ordering anything.

8. No Pets/ No Service Dogs

Some users of the property are highly allergic to animals, so please choose a different property if an animal is a must. All pets, are strictly prohibited at this property. Any evidence of pet occupation will result in a forfeit of the damage deposit in its entirety. The designation of “No Pets” does not indicate there have not been pets at the property at some time, and the Manager accepts no responsibility for any allergic reaction or other conditions arising from occupancy of the property.

9. Smoking

Smoking is not permitted in or around the property (including the garage). If smoke is detected, the Rental Applicant will be billed to deodorize the property and the deposit will be forfeited.

10. Property Access During Winter Months

The Property is offered for rental during the winter months and has road access and receives a snow clearance service from [city, county, &/or private contractor]. However, Renters are advised that following any major snowfall, snowplow providers are contracted to clear local roads in a predetermined order. Consequently, plowing at a property may be delayed for several hours or, in severe storm conditions, days. In the unlikely event that a Renter is unable to leave a property on the planned departure date, the Renter will not be liable for any additional accommodation charges. Conversely, should a lack of snow clearance prevent a Renter from reaching a property, the Renter will receive a refund of the rental fee for the day(s) the property was inaccessible. However, The Property Manager will be held responsible for any losses, additional expenses or penalties incurred as a result of being unable to arrive at or leave a property on time due to a lack of snow clearance. Renters are also reminded to ensure that they and their vehicles are suitably prepared and equipped for driving in the wintry conditions likely to be encountered during their visit to the Property. Snow will be removed at the property when it reaches 4 or more inches. If snow accumulation is under 4 inches, The Renter is responsible for any shoveling if necessary. This is a high-altitude climate, so you can expect ice and snow on the ground during the winter months. Please be cautious and wear proper footing.

11. Equipment and Facilities Provided

Equipment and facilities are provided at the discretion of The Property Manager and every attempt is made to ensure that such equipment is in working order for the duration of the rental period, should a breakdown or some other situation occur that renders non-essential element unusable, the Property Manager does not take responsibility for replacing or refunding The Renter for the lack of use of these equipment or facilities. The equipment and facilities referred to include (but are not exclusive to) such items as televisions, hot tubs, and grill. The Renter must report any inoperative or defective equipment to The Property Manager promptly! The Property Manager will make every reasonable effort to have repairs made as soon as possible; however, there are limited service contractors in Breckenridge. While every attempt will be made to ensure that all the advertised equipment and appliances are in working order at the commencement of a rental period, no reduction of rent; rebate; or refund will be issued for a mechanical failure of dishwasher, washer, dryer, TV or other appliances.

12. Refunds

If a breakdown should occur to fundamental elements such as water systems, plumbing and electrical systems, and major appliances such as stove or refrigerator, every effort will be made to repair or replace, or an appropriate refund will be made for the inconvenience caused. This does not apply to system breakdown caused by misuse, such as plumbing blockages caused by inappropriate use of sanitary facilities. The Property Manager is not liable, nor will provide a refund, for any stoppage of electrical services caused by extreme weather or other circumstances beyond his control. Similarly, there will be no refunds for inclement weather, changes in water levels, conditions at neighboring properties, or any nuisance afforded by the natural elements of the location such as flying insects or the animal population.

13. Assumption of Risk and Liability

The Manager is not responsible for any accidents, injuries, illness or damage to the persons or property of the Rental Group that occurs while on the premise or using its facilities. EACH RENTER HEREBY RELEASES, WAIVES AND DISCHARGES MANAGER OF ANY AND ALL CLAIMS, LOSSES OR DAMAGES OF ANY KIND, WHETHER IN CONTRACT, TORT OR OTHERWISE, WHETHER STATUTORY OR COMMON LAW, KNOW OR UNKNOWN, ARISING OUT OF, OR IN CONNECTION WITH, DIRECTLY OR INDIRECTLY, THE RENTAL GROUPS RENTAL OF THE PROPERTY. Each Renter accepts full responsibility for any injury, loss, or harm to him or herself, each other and their guests, including their personal property, and each Renter and any guest assumes all risks related to the use of the property.

14. Indemnification:

Each Renter represents, warrants, covenants, acknowledges and agrees to use the property and its facilities in accordance with these terms and conditions and any additional information provided in the Welcome Letter. Each Renter, jointly and severally, agrees to defend, indemnity and hold the Manager harmless from claims, demands, actions or causes of action of any kind, arising out of any claim, loss damage, injury, sickness or death, however caused, to person or property of the Rental Group, his/her family, guests or other invitees, arising out of or in connection with their rental of the property. Further, each Renter accepts full responsibility for the use of the property, and does so at his/her own risk, and further agrees to pay for any damage to the property, including any equipment or other personal property of the Manager, except as arising out of normal wear and tear.

15. Other Conditions of Booking

a. The Renter shall abide by these Terms and Conditions of Rental and any other instructions contained in the individual Welcome Letter and any additional information and instructions that shall be supplied in the Property or by The Property Manager.
b. There are NO parties/events/excessive drinking/loud music allowed at this property. This property is NOT intended to be used as a party destination.
c. Use of Hot Tub: NO DIVING. Please use the hot tub only in a safe and responsible manner, and keep them clean and free of debris.
d. Water and Septic: DO NOT flush anything other than toilet paper down the toilet. If it is found that anything other than toilet paper has been flushed, the Rental Applicant may be charged an additional fee to unclog the system.
e. Excluded Areas and Caretakers: The storage closet is excluded from this agreement. A caretaker, manager or other representative of the Owner may be on or enter the grounds of the property at any time to conduct work, inspect the property, as well as to make necessary repairs, adjustments, alterations, improvements or in case of an emergency.
f. Natural Mountain Habitat: Please be aware that you may encounter animals/insects in their natural habitat during your stay. Including but not limited to moose, foxes, bears, spiders, bees, hawks, etc. Please be mindful of how to handle a potential encounter and be careful.
g. Utilities: Thermostats must not be tampered with or reset, and must be turned off when any windows or doors are open. Excessive and/or reckless use of the home’s utilities, including electricity, gas, or water may subject the Rental Group to additional charges, at the Manager’s discretion. Thermostats are locked out in the winter at 75 degrees.
h. The security system, exterior cameras, & the noise monitoring device are there for your protection. The Renter will lose their deposit and be asked to leave immediately if they are tampered with in any way. The renter will be charged for any non-emergency response.
i. Quiet hours are 10pm-8am. NO gathering outdoors after 10pm. If the police are called, you will be fined and lose your deposit. You will also lose the remaining nights of your stay with no refund.
j. If rules are broken and you are asked to leave, you will not get a refund for the remaining nights.

Each member of the rental group acknowledges there is a hot tub spa on the premises. Each renter and every guest will use the hot tub spa at his or her own risk. Each renter agrees to occupy and use the hot tub spa in its present condition. The rental group is aware there is no lifeguard on duty on the premises at any time and takes full responsibility for persons on the property for the duration of their stay. The rental group agrees to supervise at all times all persons under the age of eighteen (18) on the property, including the hot tub spa. Each member of the rental group expressly releases, waives and discharges the property manager from any and all liability and responsibility for compliance with the applicable contained body of water requirements. Each renter also expressly releases, waives and discharges the property manager from any and all liability for any injury and/or loss of life resulting from use of the hot tub spa on the premises. 4. Cancellation Policy

Travelers who cancel at least 60 days before check-in will get back 100% of the amount they’ve paid. If they cancel after that point, we will refund any amount that gets rebooked. Travel insurance is available to cover your vacation in the event something unexpected pops up. Please ask for details if this is something you would like to purchase. Please note, while we understand that life circumstances can impact your travel plans, we cannot be held responsible for refunds within the 60 day no cancellation window.

5. Condition of the property

The property will have been inspected prior to occupation and therefore the Rental Group undertakes to:
– Notify the Manager immediately with regard to any damage and/or maintenance issues that require attention.
– Keep the property and all furniture, fixtures, fittings, chattels and effects in or about the property in the same state of repair and condition as found at the commencement of the rental period.
– DO NOT MOVE FURNITURE.
– The Rental Group shall follow the departure instructions provided by the Manager.

6. Trash/recycle and Parking

Trash: Garbage should be placed IN the trash bins in the garage or put down the trash chute. Some recycle containers are located in the parking garage. Let me know if there are any issues.
Parking: Parking will be paid for at check-in (not included in rental fee). Parking is not always guaranteed for the 2nd car. Let me know if you want to park 2 cars and I will check availability.

7. Use of Cable & Telephone

All additional cable charges must be approved before ordering anything. Where a telephone is provided as part of the rental, The Renter must charge all long-distance telephone calls to either a credit/phone card or call collect, unless advised otherwise.

8. No Pets/ No Service Dogs

All pets, are strictly prohibited at this property. Any evidence of pet occupation will result in a forfeit of the damage deposit in its entirety. The designation of “No Pets” does not indicate there have not been pets at the property at some time, and the Manager accepts no responsibility for any allergic reaction or other conditions arising from occupancy of the property.

9. Smoking

Smoking is not permitted in or on the decks. If smoke is detected, the Rental Applicant will be billed to deodorize the property and the deposit will be forfeited.

10. Property Access During Winter Months

The Property is offered for rental during the winter months and has road access and receives a snow clearance service from [city, county, &/or private contractor]. However, Renters are advised that following any major snowfall, snowplow providers are contracted to clear local roads in a predetermined order. Consequently, plowing at a property may be delayed for several hours or, in severe storm conditions, days. In the unlikely event that a Renter is unable to leave a property on the planned departure date, the Renter will not be liable for any additional accommodation charges. Conversely, should a lack of snow clearance prevent a Renter from reaching a property, the Renter will receive a refund of the rental fee for the day(s) the property was inaccessible. However, The Property Manager will be held responsible for any losses, additional expenses or penalties incurred as a result of being unable to arrive at or leave a property on time due to a lack of snow clearance. Renters are also reminded to ensure that they and their vehicles are suitably prepared and equipped for driving in the wintry conditions likely to be encountered during their visit to the Property This is a high-altitude climate, so you can expect ice and snow on the ground during the winter months. Please be cautious and wear proper footing.

11. Equipment and Facilities Provided

Equipment and facilities are provided at the discretion of The Property Manager/HOA and every attempt is made to ensure that such equipment is in working order for the duration of the rental period, should a breakdown or some other situation occur that renders non-essential element unusable, the Property Manager does not take responsibility for replacing or refunding The Renter for the lack of use of these equipment or facilities. The equipment and facilities referred to include (but are not exclusive to) such items as televisions, hot tubs, and grill. The Renter must report any inoperative or defective equipment to The Property Manager promptly! The Property Manager will make every reasonable effort to have repairs made as soon as possible; however, there are limited service contractors in Breckenridge. While every attempt will be made to ensure that all the advertised equipment and appliances are in working order at the commencement of a rental period, no reduction of rent; rebate; or refund will be issued for a mechanical failure of dishwasher, washer, dryer, TV or other appliances. If it is an HOA issue, they will be notified.
*Please note that the HOA has the authority to turn off the water in the building as needed. The Renter will be notified asap if this occurs.

12. Refunds

If a breakdown should occur to fundamental elements such as water systems, plumbing and electrical systems, and major appliances such as stove or refrigerator, every effort will be made to repair or replace, or an appropriate refund will be made for the inconvenience caused. This does not apply to system breakdown caused by misuse, such as plumbing blockages caused by inappropriate use of sanitary facilities. The Property Manager is not liable, nor will provide a refund, for any stoppage of electrical services caused by extreme weather or other circumstances beyond his control. Similarly, there will be no refunds for inclement weather, changes in water levels, conditions at neighboring properties, or any nuisance afforded by the natural elements of the location such as flying insects or the animal population. If it is a HOA issue, they will be notified.

13. Assumption of Risk and Liability

The Manager is not responsible for any accidents, injuries, illness or damage to the persons or property of the Rental Group that occurs while on the premise or using its facilities. EACH RENTER HEREBY RELEASES, WAIVES AND DISCHARGES MANAGER OF ANY AND ALL CLAIMS, LOSSES OR DAMAGES OF ANY KIND, WHETHER IN CONTRACT, TORT OR OTHERWISE, WHETHER STATUTORY OR COMMON LAW, KNOW OR UNKNOWN, ARISING OUT OF, OR IN CONNECTION WITH, DIRECTLY OR INDIRECTLY, THE RENTAL GROUPS RENTAL OF THE PROPERTY. Each Renter accepts full responsibility for any injury, loss, or harm to him or herself, each other and their guests, including their personal property, and each Renter and any guest assumes all risks related to the use of the property.

14. Indemnification

Each Renter represents, warrants, covenants, acknowledges and agrees to use the property and its facilities in accordance with these terms and conditions and any additional information provided in the Welcome Letter. Each Renter, jointly and severally, agrees to defend, indemnity and hold the Manager harmless from claims, demands, actions or causes of action of any kind, arising out of any claim, loss damage, injury, sickness or death, however caused, to person or property of the Rental Group, his/her family, guests or other invitees, arising out of or in connection with their rental of the property. Further, each Renter accepts full responsibility for the use of the property, and does so at his/her own risk, and further agrees to pay for any damage to the property, including any equipment or other personal property of the Manager, except as arising out of normal wear and tear.

15. Other Conditions of Booking

a. The Renter shall abide by these Terms and Conditions of Rental and any other instructions contained in the individual Welcome Letter and any additional information and instructions that shall be supplied in the Property or by The Property Manager.
b. There are NO parties/events/excessive drinking/loud music allowed at this property. This property is NOT intended to be used as a party destination.
c. Use of Resort Amenities: NO DIVING. Please use all amenities in a safe and responsible manner, and then them the way that they were found (or better). Follow all posted rules.
d. Water and Septic: DO NOT flush anything other than toilet paper down the toilet. If it is found that anything other than toilet paper has been flushed, the Rental Applicant may be charged an additional fee to unclog the system.
e. Excluded Areas and Caretakers: The storage closet is excluded from this agreement. A caretaker, manager or other representative of the Owner may be on or enter the grounds of the property at any time to conduct work, inspect the property, as well as to make necessary repairs, adjustments, alterations, improvements or in case of an emergency.
f. Natural Mountain Habitat: Please be aware that you may encounter animals/insects in their natural habitat during your stay. Including but not limited to moose, foxes, bears, spiders, bees, hawks, etc. Please be mindful of how to handle a potential encounter and be careful.
g. Utilities: Thermostats must not be tampered with or reset, and must be turned off when any windows or doors are open. Excessive and/or reckless use of the condo’s utilities, including electricity, gas, or water may subject the Rental Group to additional charges, at the Manager’s discretion.
i. Quiet hours are 10pm-8am. NO gathering outdoors after 10pm. If the police/security are called, you will be fined and lose your deposit. You will also lose the remaining nights of your stay with no refund.
j. If rules are broken and you are asked to leave, you will not get a refund for the remaining nights.

Each member of the rental group acknowledges there is a hot tub spa on the premises. Each renter and every guest will use the hot tub spa at his or her own risk. Each renter agrees to occupy and use the hot tub spa in its present condition. The rental group is aware there is no lifeguard on duty on the premises at any time and takes full responsibility for persons on the property for the duration of their stay. The rental group agrees to supervise at all times all persons under the age of eighteen (18) on the property, including the hot tub spa. Each member of the rental group expressly releases, waives and discharges the property manager from any and all liability and responsibility for compliance with the applicable contained body of water requirements. Each renter also expressly releases, waives and discharges the property manager from any and all liability for any injury and/or loss of life resulting from use of the hot tub spa on the premises. Each renter acknowledges receipt of this disclosure.

75th T&C

In addition to the terms of agreement established by and through the booking process, these terms and conditions further state the respective obligations and responsibilities of Modern Retreats, LLC (hereinafter “the Owner”), and the rental applicant, being the person who secured this rental property through a booking company (hereinafter, the “Rental Applicant”), and including all other individuals listed or subsequently added by the Rental Applicant (individually, a “Renter,” and collectively, the “Rental Group”). The Rental Applicant is considered to be the lead Renter and will assume full responsibility for all members of the Rental Group throughout the rental period. Information or instructions relating to this rental will be communicated to the Rental Applicant only and not to any other Renter. In the event of any dispute between the Owner, the Rental Applicant and/or the Rental Group, the provisions agreed to through the booking site as well as these terms and conditions shall form the entire agreement and the basis for any resolution. Please read them carefully before confirming your booking, as it is understood and agreed that each and every party is intending to be legally bound hereby. The Rental Group shall also abide by any other instructions contained in the Welcome Letter to be delivered at the time of occupancy.

1. Occupancy of the property

Occupancy of the property is restricted to those names initially listed through the booking company or added subsequently by the Rental Applicant. Regardless of the published maximum number of persons a property can accommodate, the total number of guests occupying the property is strictly limited to those named on the rental agreement or any subsequent amendment agreed to in writing with the Owner. The stated and agreed occupancy figure includes all persons irrespective of age, day and overnight guests. Exceeding the number of stated and agreed persons may result in immediate eviction without refund, or a $300 per additional guest per night charge, at the discretion of the Owner. Breaking any of the following rules may subject the Rental Group to dismissal from the property, and loss of any security deposit in its entirety, in addition to further damages, as arising out of any negligence, reckless or intentional misconduct of any Renter.

2. Check In/Check Out

Check-In: 4:00PM / Check-Out: By 11:00AM
If you leave the property after 11:00AM on your checkout day (without getting approval from the Owner), there will be a charge of $200/hour. For example, if you leave the property at 11:15AM, you will be charged $200.00.

3. Requirements to Confirm Reservation

AGREEMENT
Please agree to terms and conditions within 48 hours of booking,
IDENTIFICATION
Please provide a copy of your credit card and your photo ID. The credit card on file, ID, and the signer of the rental agreement all must match. This is to avoid fraud.
DEPOSIT INFORMATION
We take a 50% deposit at the time of the booking, and the remaining 50% is due 60 days prior to your arrival. If you are booking within 60 days of arrival, the full amount will be charged upon booking.

– The pool vacuum MUST stay in the pool at all times. If the hose gets in the way, move the hose to the side, leaving the suction in the pool. Taking the whole vacuum unit out of the pool will result in damage and the renter will be charged.
– The Rental Group shall follow the departure instructions provided by the Owner.

6. Parking and Trash

Trash and Recyclables: Garbage and Recycle cans must be kept out of sight, and are allowed out for a reasonable amount of time on collection days. The collection schedule is outlined in the Welcome Letter. Please have all trash and recycle in the correct bin the night before pickup. The bins will be moved to and from the curb by Can Monkey. Let me know if there are any issues.
Parking: Please note that street parking is not permitted. A maximum of 3 guest vehicles may be parked at the property at any time during the stay. Garage doors must generally be kept down.

7. Use of Cable

All additional cable charges must be approved before ordering anything.

8. No Pets/ No Service Dogs

Some users of the property are highly allergic to animals, so please choose a different property if an animal is a must. All pets are strictly prohibited at this property. Any evidence of pet occupation will result in a forfeit of the damage deposit in its entirety. The designation of “No Pets” does not indicate there have not been pets at the property at some time, and the Owner accepts no responsibility for any allergic reaction or other conditions arising from occupancy of the property.

Equipment and appliances, such as televisions, kitchen appliances, the pool and hot tub/spa, laundry facilities, and the grill are provided are amenities and not guaranteed under the terms of this agreement. The Owner will use commercially reasonable efforts to ensure that such equipment and appliances are in working order for the duration of the rental period. Should a breakdown or some other situation occur that renders any equipment or appliance unusable, the Owner will make commercially reasonable efforts to have it promptly repaired; however, there may be times when service contractors in Scottsdale are unavailable on short notice. The Rental Group must report any inoperative or defective equipment or appliance to the Owner promptly. There shall be no reduction of rent, rebate, or refund for the mechanical failure of any equipment or appliances, except at the discretion of the Owner.

Similarly, there will be no refunds for inclement weather, changes in water levels, conditions at neighboring properties, or any nuisance afforded by the natural elements of the location such as flying insects or the animal population.

Each Renter accepts full responsibility for any injury, loss, or harm to him or herself, each other and their guests, including their personal property, and each Renter and any guest assumes all risks related to the use of the property.

b. Use of pool and Hot Tub: NO DIVING. Please use the pool and hot tub spa only in a safe and responsible manner, and keep them clean and free of debris. DO NOT adjust the temperature of the pool. If there is an issue with water temperature, or other issue with the pool, please contact the owner. You will be fined if you adjust or make changes to the equipment.
c. Firepit: This property has one outdoor firepit. Keep all wood, paper, clothing or other combustible materials away from the firepit. ALWAYS turn off the gas after every use. Do not leave unattended.
d. Water and Septic: DO NOT flush anything other than toilet paper down the toilet. If it is found that anything other than toilet paper has been flushed, the Rental Applicant may be charged an additional fee to unclog the system.
e. Put umbrellas down when it’s windy or they are not in use. You will be charged for damaged umbrellas. Please make sure everything (furniture, games, and athletic equipment) is put back in its original place.
f. Natural Desert Habitat: Please be aware that you may encounter natural inhabitants of the Sonoran Desert on the property during your stay, including but not limited to scorpions, rodents, spiders, cockroaches, bees, owls, hawks, rattlesnakes or other reptiles. Please be mindful of how to handle a potential encounter and be careful.
g. Excluded Areas and Caretakers: Garage closet and some storage closets are excluded from this agreement. A caretaker, manager or other representative of the Owner may be on or enter the grounds of the property at any time to conduct work, inspect the property, as well as to make necessary repairs, adjustments, alterations, improvements or in case of an emergency. Pool service and yard maintenance occur regularly and these service technicians may also be on the grounds of the property at any time.
h. Utilities: Thermostats must not be tampered with or reset, and must be turned off when any windows or doors are open. Excessive and/or reckless use of the home’s utilities, including electricity, gas, or water may subject the Rental Group to additional charges, at the Owner’s discretion. Thermostats are locked out at 70 degrees.
i. The security system & exterior cameras are there for your protection. The Renter will lose their deposit and be asked to leave immediately if the cameras are tampered with in any way. The renter will be charged for any non-emergency response.
j. Quiet hours are 10pm-8am. NO gathering outdoors after 10pm. If the police are called, you will be fined $3,000 and lose your deposit. You will also lose the remaining nights of your stay with no refund. Noise monitoring devises are onsite.
k. If rules are broken and you are asked to leave, you will not get a refund for the remaining nights.

15. Additional Pool and Hot Tub Spa Provisions

EACH MEMBER OF THE RENTAL GROUP ACKNOWLEDGES THERE IS A SWIMMING POOL AND HOT TUB SPA ON THE PREMISES. EACH RENTER AND EVERY GUEST WILL USE THE SWIMMING POOL AND/OR HOT TUB SPA AT HIS OR HER OWN RISK. EACH RENTER AGREES TO OCCUPY AND USE THE POOL AND HOT TUB SPA IN ITS PRESENT CONDITION. THE RENTAL GROUP IS AWARE THERE IS NO LIFEGUARD ON DUTY ON THE PREMISES AT ANY TIME AND TAKES FULL RESPONSIBILITY FOR PERSONS ON THE PROPERTY FOR THE DURATION OF THEIR STAY. THE RENTAL GROUP AGREES TO SUPERVISE AT ALL TIMES ALL PERSONS UNDER THE AGE OF EIGHTEEN (18) ON THE PROPERTY, INCLUDING THE POOL AND HOT TUB SPA. EACH MEMBER OF THE RENTAL GROUP EXPRESSLY RELEASES, WAIVES AND DISCHARGES THE OWNER FROM ANY AND ALL LIABILITY AND RESPONSIBILITY FOR COMPLIANCE WITH THE APPLICABLE CONTAINED BODY OF WATER REQUIREMENTS. EACH RENTER ALSO EXPRESSLY RELEASES, WAIVES AND DISCHARGES THE OWNER FROM ANY AND ALL LIABILITY FOR ANY INJURY AND/OR LOSS OF LIFE RESULTING FROM USE OF THE POOL AND/OR HOT TUB SPA ON THE PREMISES. EACH RENTER ACKNOWLEDGES RECEIPT OF THIS DISCLOSURE.

Should a breakdown or some other situation occur that renders any equipment or appliance unusable, the Manager will make commercially reasonable efforts to have it promptly repaired; however, there may be times when service contractors in Scottsdale are unavailable on short notice. The Rental Group must report any inoperative or defective equipment or appliance to the Manager promptly. There shall be no reduction of rent, rebate, or refund for the mechanical failure of any equipment or appliances, except at the discretion of the Manager.

11. Refunds

If a breakdown should occur to fundamental elements such as water systems, plumbing and electrical systems, and major appliances such as stove or refrigerator, commercially reasonable efforts will be made to repair or replace the defective system as soon as possible, or an appropriate refund will be made for the inconvenience caused. This does not apply to any system breakdown caused by misuse, such as plumbing blockages, or other breakdowns caused by inappropriate use of equipment, appliances or facilities. The Manager is not liable, nor will Manager provide a refund, for any stoppage of electrical or other services caused by extreme weather or other circumstances beyond Manager’s control. Similarly, there will be no refunds for inclement weather, changes in water levels, conditions at neighboring properties, or any nuisance afforded by the natural elements of the location such as flying insects or the animal population.

12. Assumption of Risk and Liability

The Manager is not responsible for any accidents, injuries, illness or damage to the persons or property of the Rental Group that occurs while on the premise or using its facilities. EACH RENTER HEREBY RELEASES, WAIVES AND DISCHARGES MANAGER OF ANY AND ALL CLAIMS, LOSSES OR DAMAGES OF ANY KIND, WHETHER IN CONTRACT, TORT OR OTHERWISE, WHETHER STATUTORY OR COMMON LAW, KNOW OR UNKNOWN, ARISING OUT OF, OR IN CONNECTION WITH, DIRECTLY OR INDIRECTLY, THE RENTAL GROUPS RENTAL OF THE PROPERTY. Each Renter accepts full responsibility for any injury, loss, or harm to him or herself, each other and their guests, including their personal property, and each Renter and any guest assumes all risks related to the use of the property.

13. Indemnification:

Each Renter represents, warrants, covenants, acknowledges and agrees to use the property and its facilities in accordance with these terms and conditions and any additional information provided in the Welcome Letter. Each Renter, jointly and severally, agrees to defend, indemnity and hold the Manager harmless from claims, demands, actions or causes of action of any kind, arising out of any claim, loss damage, injury, sickness or death, however caused, to person or property of the Rental Group, his/her family, guests or other invitees, arising out of or in connection with their rental of the property. Further, each Renter accepts full responsibility for the use of the property, and does so at his/her own risk, and further agrees to pay for any damage to the property, including any equipment or other personal property of the Manager, except as arising out of normal wear and tear.

14. Other Conditions

a. There are NO parties/events/excessive drinking/loud music allowed at this property. This property is NOT intended to be used as a party destination.
b. Use of pool and Hot Tub: NO DIVING. Please use the pool and hot tub spa only in a safe and responsible manner, and keep them clean and free of debris. DO NOT adjust the temperature of the pool. If there is an issue with water temperature, or other issue with the pool, please contact the Manager. You will be fined if you adjust or make changes to the equipment.
c. Firepit: This property has one outdoor firepit. Keep all wood, paper, clothing or other combustible materials away from the firepit. ALWAYS turn off the gas after every use. Do not leave unattended.
d. Water and Septic: DO NOT flush anything other than toilet paper down the toilet. If it is found that anything other than toilet paper has been flushed, the Rental Applicant may be charged an additional fee to unclog the system.
e. Put umbrellas down when it’s windy or they are not in use. You will be charged for damaged umbrellas. Please make sure everything (furniture, games, and athletic equipment) is put back in its original place.
f. Natural Desert Habitat: Please be aware that you may encounter natural inhabitants of the Sonoran Desert on the property during your stay, including but not limited to scorpions, rodents, spiders, cockroaches, bees, owls, hawks, rattlesnakes or other reptiles. Please be mindful of how to handle a potential encounter and be careful.
g. Excluded Areas and Caretakers: Garage closet and some storage closets are excluded from this agreement. A caretaker, manager or other representative of the Manager may be on or enter the grounds of the property at any time to conduct work, inspect the property, as well as to make necessary repairs, adjustments, alterations, improvements or in case of an emergency. Pool service and yard maintenance occur regularly and these service technicians may also be on the grounds of the property at any time.
h. Utilities: Thermostats must not be tampered with or reset, and must be turned off when any windows or doors are open. Excessive and/or reckless use of the home’s utilities, including electricity, gas, or water may subject the Rental Group to additional charges, at the Manager’s discretion. Thermostats are locked out at 70 degrees.
i. The security system & exterior cameras are there for your protection. The Renter will lose their deposit and be asked to leave immediately if the cameras are tampered with in any way. The renter will be charged for any non-emergency response.
j. Quiet hours are 10pm-8am. NO gathering outdoors after 10pm. If the police are called, you will be fined $3,000 and lose your deposit. You will also lose the remaining nights of your stay with no refund. Noise monitoring devises are onsite.
k. If rules are broken and you are asked to leave, you will not get a refund for the remaining nights.

15. Additional Pool and Hot Tub Spa Provisions

Each member of the rental group acknowledges there is a swimming pool and hot tub spa on the premises. Each renter and every guest will use the swimming pool and/or hot tub spa at his or her own risk. Each renter agrees to occupy and use the pool and hot tub spa in its present condition. The rental group is aware there is no lifeguard on duty on the premises at any time and takes full responsibility for persons on the property for the duration of their stay. The rental group agrees to supervise at all times all persons under the age of eighteen (18) on the property, including the pool and hot tub spa. Each member of the rental group expressly releases, waives and discharges the manager from any and all liability and responsibility for compliance with the applicable contained body of water requirements. Each renter also expressly releases, waives and discharges the manager from any and all liability for any injury and/or loss of life resulting from use of the pool and/or hot tub spa on the premises. Each renter acknowledges receipt of this disclosure.

DREYFUS T&C

In addition to the terms of agreement established by and through the booking process, these terms and conditions further state the respective obligations and responsibilities of Modern Retreats, LLC (hereinafter “the Manager”), and the rental applicant, being the person who secured this rental property through a booking company (hereinafter, the “Rental Applicant”), and including all other individuals listed or subsequently added by the Rental Applicant (individually, a “Renter,” and collectively, the “Rental Group”). The Rental Applicant is considered to be the lead Renter and will assume full responsibility for all members of the Rental Group throughout the rental period. Information or instructions relating to this rental will be communicated to the Rental Applicant only and not to any other Renter. In the event of any dispute between the Manager, the Rental Applicant and/or the Rental Group, the provisions agreed to through the booking site as well as these terms and conditions shall form the entire agreement and the basis for any resolution. Please read them carefully before confirming your booking, as it is understood and agreed that each and every party is intending to be legally bound hereby. The Rental Group shall also abide by any other instructions contained in the Welcome Letter to be delivered at the time of occupancy.

1. Occupancy of the property

Occupancy of the property is restricted to those names initially listed through the booking company or added subsequently by the Rental Applicant. Regardless of the published maximum number of persons a property can accommodate, the total number of guests occupying the property is strictly limited to those named on the rental agreement or any subsequent amendment agreed to in writing with the Manager. The stated and agreed occupancy figure includes all persons irrespective of age, day and overnight guests. Exceeding the number of stated and agreed persons may result in immediate eviction without refund, or a $300 per additional guest per night charge, at the discretion of the Manager. Breaking any of the following rules may subject the Rental Group to dismissal from the property, and loss of any security deposit in its entirety, in addition to further damages, as arising out of any negligence, reckless or intentional misconduct of any Renter.

2. Check In/Check Out

Check-In: 4:00PM / Check-Out: By 11:00AM
If you leave the property after 11:00AM on your checkout day (without getting approval from the Manager), there will be a charge of $200/hour. For example, if you leave the property at 11:15AM, you will be charged $200.00.

3. Requirements to Confirm Reservation

AGREEMENT
Please agree to terms and conditions within 48 hours of booking,
IDENTIFICATION
Please provide a copy of your credit card and your photo ID. The credit card on file, ID, and the signer of the rental agreement all must match. This is to avoid fraud.
DEPOSIT INFORMATION
We take a 50% deposit at the time of the booking, and the remaining 50% is due 60 days prior to your arrival. If you are booking within 60 days of arrival, the full amount will be charged upon booking.

4. Cancellation Policy

Travelers who cancel at least 60 days before check-in will get back 100% of the amount they’ve paid. If they cancel after that point, we will refund any amount that gets rebooked. Travel insurance is available to cover your vacation in the event something unexpected pops up. Please ask for details if this is something you would like to purchase. Please note, while we understand that life circumstances can impact your travel plans, we cannot be held responsible for refunds within the 60 day no cancellation window.

5. Condition of the property

The property will have been inspected prior to occupation and therefore the Rental Group undertakes to:
– Notify the Manager immediately with regard to any damage and/or maintenance issues that require attention.
– Keep the property and all furniture, fixtures, fittings, chattels and effects in or about the property in the same state of repair and condition as found at the commencement of the rental period.
– DO NOT MOVE FURNITURE.
– The Rental Group shall follow the departure instructions provided by the Manager.

6. Parking and Trash

Trash and Recyclables: Garbage and Recycle cans must be kept out of sight, and are allowed out for a reasonable amount of time on collection days. The collection schedule is outlined in the Welcome Letter. Please have all trash and recycle in the correct bin the night before pickup. The bins will be moved to and from the curb by Can Monkey. Let me know if there are any issues.
Parking: Please note that street parking is not permitted. A maximum of 3 guest vehicles may be parked at the property at any time during the stay. Garage doors must generally be kept down.

7. Use of Cable

All additional cable charges must be approved before ordering anything.

8. No Pets/ No Service Dogs

Some users of the property are highly allergic to animals, so please choose a different property if an animal is a must. All pets are strictly prohibited at this property. Any evidence of pet occupation will result in a forfeit of the damage deposit in its entirety. The designation of “No Pets” does not indicate there have not been pets at the property at some time, and the Manager accepts no responsibility for any allergic reaction or other conditions arising from occupancy of the property.

9. Smoking

Smoking is not permitted in or around the property (including the garage). If smoke is detected, the Rental Applicant will be billed to deodorize the property and the deposit will be forfeited.

10. Equipment and Facilities Provided

Equipment and appliances, such as televisions, kitchen appliances, the pool and hot tub/spa, laundry facilities, and the grill are provided are amenities and not guaranteed under the terms of this agreement. The Manager will use commercially reasonable efforts to ensure that such equipment and appliances are in working order for the duration of the rental period.
